La Mesa man dies in accident

An accident on June 16th left a 45-year-old La Mesa man dead. The man was traveling southbound on Interstate 5 near Camp Pendleton when his BMW drifted into the dirt median. Two trucks were parked in this median by a contractor who was working on a guardrail for Caltrans. The BMW struck the back of one of the trucks sideways. He died immediately.

$100,000 awarded in ‘07 accident

A settlement has been reached in a lawsuit regarding at 2007 accident. 76-year-old Marilyn Clark was the passenger in a car being driven by her husband. The couple was crossing an intersection when the driver of a Navigator, Mohammed Zeidan, ran a red light. Mr. Zeidan collided with the passenger side of the Clarks’ vehicle. Ms. Clark fractured her jaw and ribs and also suffered a collapsed lung.  

The Clarks sued Mr. Zeidan for negligence, which he did not dispute. A settlement was reached for $100,000.

Ironworker killed in downtown San Diego

An ironworker employed by Kaylake Industries was killed on June 12th in downtown
San Diego. 21-year-old Valentin Michel Madrigal was working at 10th and A Streets on the 35th floor of Vantage Point condominiums. Mr. Madrigal was attempting to connect his safety harness to another hook when he lost his footing and fell to the balcony on the 10th floor. He was pronounced dead at the scene. Cal-OSHA is investigating to find if any violations of the Health and Safety Code were committed.

Skateboarder killed in Otay Mesa

A 19-year-old man was killed in an accident on June 11th in Otay Mesa. Robert Pletzer was riding his skateboard on Picador Boulevard near Route 95 at approximately 2:30 a.m. Mr. Pletzer drifted into the road and into the path of an oncoming car. He was struck by the vehicle and taken to UCSD Medical Center. He suffered an open fracture to his leg and a severe head injury, of which he later died.

$7.25 million awarded in pit bull attack

A Kansas City man received $7.25 million for injuries he suffered after a 2006 pit bull attack. The dogs were owned by Paul Piper and Bryan Smith, who were living in a property owned by Brittnee Ann Wisdom and James K. Knowles. Ms.Wisdom, Mr. Knowles, and Ms. Wisdom’s mother, Nancy, had all made attempts to remove the dogs from the property. Brittnee left several notes for Mr. Piper, instructing him to cage or fence the animals. On the morning that Mr. Hill was attacked, the Wisdoms contacted animal control officers to remove the dogs from the property. Before animal control officers could remove the pit bulls, the dogs escaped out of an open window, eventually attacking Mr. Hill who was mowing the lawn in a vacant lot. The dogs were killed by police when they were located.

Mr. Hill remained on a feeding tube for over a month and suffered lacerations to his face as well as his arms and legs. He also suffered organ failure and now has permanent disfiguration and disabling injuries. The cost of his medical bills was over $500,000 and his loss of income was greater than $1 million. He was awarded $7.25 million and his wife, Connie, received $300,000.

Mr. Smith was sentenced to a year in jail, and Mr. Piper was also convicted. The attack has shed light on the need for tougher laws on dangerous dogs.

Defendant dismissed from 2007 construction accident case

A defendant has been dismissed from a personal injury lawsuit stemming from a 2007 construction accident. Two workers were killed and several injured when formwork collapsed on construction at the Bay St. Louis Bridge. The victims fell 50 feet. It was initially believed that a Matthews Marine tugboat struck a column of the bridge, causing it to collapse. That turned out to be false, so Matthews Marine has been removed from liability.

The lawsuit names Granite Archer Western, HNTB Corp., URS Corp., D.T. Reed Steel Co., Gulf Concrete, EFCO, Civil Tech and Burns Cooley Dennis as negligent. Four of those companies were fined almost $96,000 from the Occupational Safety and Health Administration. The lawsuit represents seven construction workers and five of their wives for the physical and psychological injuries received as a result of negligence from companies involved.

Girl killed after accident with farm vehicle

A 16-year-old girl was killed after a farm vehicle accident on June 10th. Catherine Peltzur and a 15-year-old boy were riding in a Kubota RTV-900, a vehicle without doors that has a front bench seat and a cargo bed. Catherine lost control of the vehicle on Oak Trail Road and it went off the shoulder. It then tumbled down an embankment and both teens were ejected from the vehicle. They were transported to Palomar Medical Center in Escondio, where Catherine later died of major internal injuries. The boy suffered cuts to his face.

Imperial Beach man killed in accident

A 38-year-old man from Imperial Beach died in an accident in Spring Valley. Gaunther Cortez Burns was traveling eastbound on Route 54 west of Jamacha Boulevard when his 1992 Lexus drifted into the center divider. Mr. Burns then struck a sign pole and a guardrail. This caused the vehicle to flip, eventually landing in a ravine. Mr. Burns was ejected from the vehicle.

Family of cancer patient wins $400,000

A case has been settled regarding the 2005 death of a woman from colon cancer. For two years, L. Adams received health care from the Tricare Clinic Clairemont Mesa. Her family claimed that she had repeatedly asked for a colonoscopy, due to the fact that her father had died of colon cancer. A fecal occult blood test was eventually ordered. The results were negative, and a colonoscopy was not done.  In 2003, L. Adams visited the Luke Air Force Base Hospital in Arizona for epigastric pain. An ultrasound found that she had lesions in her liver. She was believed to have State IV colon cancer, and she passed away from the disease in 2005.    

The family of L. Adams requested $1.5 million in physicians’ negligence against United States of American, Foundation Health Federal Services, and other confidential parties. A settlement was reached at $400,000.

Man killed after rear-ending delivery truck

82-year-old William Charles Duffy was killed after an accident on June 6th in Oceanside. Mr. Duffy was merging on to northbound I-5 from Oceanside Boulevard when his vehicle drifted to the right. A Sparkletts water delivery truck was completely pulled over on the right shoulder due to mechanical difficulties, and Mr. Duffy rear-ended the truck. He died at the scene. Authorities found that there was no evidence that Mr. Duffy had attempted to stop before the accident, so perhaps a medical condition caused the accident.
