A case has been settled regarding injuries received in a 2007 accident. 57-year-old Mary Jackson was on her way to work when she was struck by another vehicle driven by Steven Almeida. Mr. Almeida admitted that he had fallen asleep at the wheel. Mrs. Jackson suffered a stroke and spent six weeks in a coma. She also suffered a fractured leg and needed an operation to her knee. The victim’s husband sued Mr. Almeida for loss of consortium. A settlement of $2,150,000 was reached.

An accident at a Pacific Beach farmers market left three people injured. A 40-year-old driver was exiting the parking lot of the Promenade Mall when his clutch malfunctioned, causing him to strike three pedestrians. One of the victims, a 70-year-old man, suffered a broken leg, and two other women got minor scrapes. All three victims were transported to the hospital. The driver was not arrested.

A popular San Diego band member was killed in an accident on June 28th. 40-year-old Craig Yerkes of the band The Grams was speeding as he was traveling on Camino del Rey in Bonsall. Witnesses estimated that the vehicle was going over 100 mph when it struck a tree at approximately 11:30 a.m. The cause of the accident is still being investigated. Mr. Yerkes’ band had been awarded at the last two San Diego Music Awards.

A young man is in the hospital after being struck by a car in National City. 20-year-old Edgar Salario was running after a soccer ball on Euclid Avenue on June 28th. A man driving a 1990 Honda Accord struck Mr. Salario just south of 16th Street, resulting in two broken arms. The victim was transported to a hospital in Hillcrest where he is said to be in fair condition. The driver of the Honda fled the scene, and the vehicle was found abandoned several blocks from the accident.

A lawsuit has been settled regarding the injuries a couple received after a helicopter crash in 2007. Doug and Judy Barton were passengers on a helicopter tour of Kaua’i, and were approximately 1000 feet in the air when the tail section of the helicopter blew apart. The pilot tried to slow the aircraft’s fall, but he was unable to prevent the crash. 61-year-old Doug Barton and 52-year-old Judy both suffered spinal injuries. Mr. Barton is now in severe pain when walking, and Mrs. Barton has no feeling below her waist and no bladder or bowel functions. She needs daily nursing assistance. The Bartons’ medical bills have reached $750,000. Another passenger, Michael Gershon, was killed, and both the pilot, Donald Torres, and a fourth passenger, Dania Hansen, were injured.
The cause of the crash is believed to be a defective fitting in the tail rotor. After some research, it was found that the helicopter had 16 tail rotor failures, with 10 of them being caused by metal fatigue. After the crash, the National Transportation Safety Board stopped the use of all similar aircraft. It was discovered that two helicopters in
New Zealand had the same defect. This crash was the second in three days in Kaua’i, with the first crash killing four people.
The Bartons filed a lawsuit against Aluminum Precision Products Inc., the manufacturer of the defective fitting, Smoky Mountain Helicopters, who owned the aircraft, and the Boeing Co., which has merged with McDonnell Douglas, and built the helicopter. They were awarded $9.5 million.

The parents of a Georgia boy who died in an accident have been awarded $3.5 million. 14-year-old Matthew Reynolds was the passenger in his mother’s 1995 Chevy Blazer in June of 2002. They were traveling southbound on Interstate 985 in Gainesville when a drunk driver collided with the Reynolds’ vehicle. The Blazer flipped, throwing Matthew from the SUV. He was transported to Grady Memorial Hospital by helicopter, where he later died.
The Reynolds sued General Motors for the Blazer’s poor design, which made it prone to rolling. In 1995 the Blazer was re-engineered, but attorneys for the Reynolds argued that the vehicle was still unstable. The Chevy Blazer was eventually discontinued, with the TrailBlazer manufactured in its place. The TrailBlazer’s wheel base is less narrow than the Blazer, making it less likely to tip. GM was ordered to pay $3.5 million to the Reynolds family.

A fatal accident in East County killed one person and started a brush fire that burned over 50 acres. At approximately 5:00 a.m., a 2002 Volkswagen drove off Interstate 8 west of
Carrizo Gorge Drive. The vehicle fell 100 feet down an embankment and erupted in an explosion. That explosion caused a brush fire that spread quickly due to the dry, sweltering conditions. The blaze required 200 firefighters, four air tankers, and four helicopters to control. It was expected to be fully contained by late afternoon, but firefighters may remain on the scene as late as 10:00 p.m. No homes were damaged by the fire. The driver of the Volkswagen has not yet been identified; however the vehicle had an Ohio license plate and was registered to a 19-year-old stationed at Camp Pendleton.

A pedestrian has died after being struck by a car in Moreno Valley. The adult male, who has not yet been identified, was walking on Alessandro Boulevard near Ramsdell Drive when he walked into the path of a car traveling eastbound. The driver, a 20-year-old man, was driving a Honda Accord, and did not appear to be intoxicated. The pedestrian died at the scene.

A pet store chain has been sued in a wrongful death case after a man died from an illness contracted by a pet bought at the store. After purchasing a cockatiel from a Texas PetSmart in 2006, 63-year-old Joe de la Garza contracted psittacosis, which is a bacterial infection carried by certain bird species. The sickness is also known as “parrot fever.” Mr. de la Garza died less than three weeks after being infected with the disease. His daughter was also hospitalized from the illness.
A spokesperson for PetSmart stated that when good hygiene is practiced, it is very unlikely that a human will contract psittacosis. However, late last year, the sale of birds was temporarily stopped country-wide after a threat of the illness.

$988,850 has been awarded to a woman who suffered injuries after being unsupervised at a nursing home. In September of 2007, 83-year-old Elizabeth Gladys had been residing at an assisted living center for nearly two years. At approximately 5:00 a.m. on September 20th, Ms. Gladys, who suffered from dementia, exited the building. In doing so, she set off a door alarm. Three staff members were on the premises, two of which did not hear the alarm, and one was on the phone. Ms. Gladys was found about 20 minutes later by a neighbor who lived several houses away from the facility. She had suffered an intertrochanteric fracture of her hip and subdural hematoma with cognitive impairment.
The Department of Social Services issued a complaint against the facility for failing to provide adequate care to a resident suffering from dementia, leading the resident to suffer injuries. They demanded $1.2 million, and the facility offered $300,000. A final settlement of $988,850 was reached.
