Jury awards $10million to woman who suffered brain damage from accident

A Middlesex County, Massachusetts jury, after only four hours of deliberation, awarded a 58-year-old Somerville woman $10 million dollars according to an article posted in boston.com.

The plaintiff, Louise Scialdone, suffered brain damage when she was hit by a Massachusetts Bay Transportation Authority bus while waiting to get to work. Scialdone is not able to work and has trouble with balance and her memory and can only comprehend material on a third grade level.

The accident occurred February 4, 2004 on an icy day. Scialdone, who used a walker because of arthritis, was waiting at a bus stop on her way to her clerk’s job at the Massachusetts Department of Transitional Assistance when the bus driver lost control of the vehicle, fishtailed onto the sidewalk and knocked Scialdone off her feet. She was thrown five feet and her head hit a parked car, knocking her unconscious.

Federal officials have opened an investigation as to whether landlords in Galveston are not complying with a federal law designed to protect children from lead poisoning.

A recent Housing and Urban Development study shows that nearly one in five children have high levels of lead in their blood, prompting officials to look more closely at landlords in Galveston, Texas.

The H.U.D. probe also stems from a January 27th Houston Chronicle story focusing on the problem of lead in buildings in the Galveston area. According to the article, “the problem stems from paint on old houses, particularly those built before 1978, when the federal government banned residential lead paint.”
