Mitsubishi Motor Trial set to Start in Florida

Mitsubishi Motors is accused of neglecting a seatbelt defect that may have caused a death in a rollover accident.

The product liability trial is set to begin Monday, February 4, 2008.

The lawsuit, filed in Circuit Court in Palm Beach County, Fla., says a seatbelt in a 2001 Montero sport utility vehicle, designed to introduce 10 inches of slack during an accident, led to the September 2004 death of Scott Laliberte, a 25 year-old college student.

$3.2 million awarded in birthing malpractice case

Kaiser Permanente must pay $3.2 million to a 14-year-old Lake Forest girl who wasn’t breathing and suffered brain damage when delivered by Caesarean section.

Court documents indicate the girl now suffers from physical and behavioral problems.

The $3.2 million has purchased an annuity worth $20 million over her lifetime. She will receive the first payment at 18.

Appelate Court Upholds $13 million dollar settlement

The Nassau County Legislature unanimously approved a $13 million award and voted a bond issue to pay for it. The award stemmed from a lawsuit filed 13 years ago after a woman was seriously injured in an auto accident.

The victim, Merryl Kihl, was a passenger in a car that skidded out of control on wet pavement and struck a tree in 1995. She sustained a fractured neck along with other severe injuries.

Earlier court decisions had found that the road was unsafe, leaving the county with few options but to pay the award.

Jury awards $15.3 million in asbestos case

A sealant company in Baltimore, Maryland was ordered to pay $15.3 to a 73-year-old man after it was determined that he developed Mesothelioma from exposure  to asbesto-containing products the company made.

The plaintiff, George J. Linkus, worked for the Key Highway Shipyard, from 1952 through 1959. In 1954 he was moved to the machine shop where he was exposed to rope that was found to contain asbestos.

Mesothelioma is a cancer that is directly caused by exposure to asbestos.

Jury awards burn victim $1.5 million

A jury in Anderson, Indiana has awarded $1.5 million to a mentally disabled man who suffered first- and second-degree burns when he was placed in a bathtub of scalding water.

The assisted living home where the man suffered the injury provides services to mentally disabled clients.

The jury decided Residential CRF, the assisted living home, must pay $1.125 million in damages, while Family and Social Services owes $375,000.
