Rainy weather causes problems for drivers

According to the San Diego Metro News, the National Weather Service has issued a flash-flood warning for all but the desert portions of San Diego county.

The rain is expected to fall from the coast to the mountains throughout Friday and into Saturday. Drivers are urged to use extra caution.

According to the Union Tribune, “the CHP said there were 123 accidents after midnight on local freeways, with at least 63 accidents reported between 8 a.m. and noon.” During a normal 24 hour period, there are usually only 50 to 75 accidents reported on San Diego freeways. eIf you have been involved in an auto accident because of someone else’s negligence or hazardous driving during this inclement weather you may be entitled to compenation.

Pit Bull owner charged with felony in dog attack on letter carrier

 A Westminister, California pit bull owner whose dog attacked and viciously bit a U.S Postal Letter Carrier was charged with a felony. If convicted, she could face three years on prison.

The attack occurred on September 4th when postal carrier David Carroll was knocked down and repeatedly bitten in the face by the pit bull of owner, Sheri Moody.

According to the Associated Press, the letter carrier may need reconstructive surgery to repair the damage to his face and left eye.

Lawsuit claims GM/Toyota manufactured automobiles with faulty defects

According to a certified auditor who worked for more than 23 years at New United Motor Inc., managers at a GM/Toyota manufacturing plant allowed serious defects to go unchecked.

The defects included faulty seat belts and brakes as well as faulty headlights, engine oil leaks, mirrors that fall off, and steering wheel alignment problems.

State Farm Wins Appeal to Deny Coverage in Katrina Case

A federal appeals court upheld the language in State Farm’s  Insurance Company’s homeowners policy that has been used to deny hundreds of claims made by policy holders whose homes were damaged or destroyed by Hurricane Katrina.

The bad faith insurance case against State Farm Insurance was filed by John and Claire Tuepker whose Long Beach, Mississippi home was destroyed by Hurricane Katrina on August 29, 2005.

The appeals court judges ruled that State Farm’s homeowners policy is not written in ambiguous language. The insurance company argued that its policies cover damage from a hurricane’s winds but not from rising water. The insurance company also claimed that damage from both wind and flood waters can be excluded from coverage by “anti-concurrent cause” language in its policies.
